This Privacy Policy explains how Jacques Torres Chocolate ("we," "us") collects, uses and shares personal information when you visit mrchocolate.com, shop with us online, contact us, join our rewards program or sign up for our emails. It does not cover purchases made in our retail stores, except where those purchases are linked to your online account or rewards membership.

Information we collect

Information you give us

Contact and order details: name, email address, phone number, billing and shipping addresses, order history.
Gift details: recipients' names, addresses, phone numbers and gift messages. Please only give us someone else's details if you have their permission.
Account and rewards details: login email, rewards points and activity, including points earned for following us on social media.
Communications: messages you send us, corporate or wholesale enquiries, form submissions, reviews and survey answers.
Payment information: card details you enter at checkout are processed by Shopify and its payment partners. We do not receive or store full card numbers.

Information collected automatically (most of it only with your permission; see our Cookie Policy)

Device and online identifiers: IP address, browser type, device type, cookie IDs and similar identifiers. We treat these as personal information.
Activity on our site: pages viewed, products browsed, items added to cart, links clicked, and whether you open or click our emails.
Approximate location: country, state or city, worked out from your IP address.

Information from others

Advertising and analytics partners, such as how you responded to our ads.
Social media platforms, if you interact with our pages or link an account.
People who send you a gift from us.

How we use your information

To process, ship and deliver orders, including gifts, and to send order updates.
To run your account and rewards membership.
To answer questions and provide customer service.
To send marketing emails you have signed up for.
To show you relevant ads on other sites and apps and measure how well our ads work (only with your permission).
To understand how our site is used and improve it (only with your permission).
To prevent fraud, keep the site secure and comply with the law.

We share personal information only as described here.

Service providers who work for us under contract: Shopify (store and checkout), payment processors, shipping carriers, Klaviyo (email marketing), Yotpo (reviews), Smile.io (rewards), Giftship (gifting), Pandectes (consent management) and customer service tools.
Advertising and analytics partners such as Google, Meta, Pinterest, Microsoft, TikTok, LinkedIn, OpenAI and impact.com (our affiliate network), only if you accept advertising or analytics cookies. Under some US state laws this counts as "selling" or "sharing" personal information for targeted advertising. You can opt out at any time (see Your privacy choices).
Legal and safety reasons: to comply with law, respond to legal process, or protect our customers, our business or others.
Business transfers: if our business or its assets are sold or merged, personal information may be transferred as part of that transaction.

We do not sell lists of customer email addresses or phone numbers.

Account details: update them by logging in to your account.

Your US state privacy rights

Depending on where you live (including California, Colorado, Connecticut, Virginia, Texas, Oregon and other states with consumer privacy laws), you may have the right to:

know what personal information we collect, use and share, and get a copy of it;
correct information that is inaccurate;
delete your personal information;
opt out of the sale or sharing of your personal information and targeted advertising;
limit the use of sensitive personal information (we do not collect it for that purpose);
appeal if we deny your request.

We will not treat you differently for using these rights.

We will verify your request by matching the information you give us with what we hold. An authorized agent may make a request for you with your signed permission. If we deny your request, you can appeal by replying to our decision. If your appeal is denied, you may contact your state attorney general.

We do not collect sensitive personal information such as Social Security numbers, health data or precise location.

Notice of financial incentive

We offer 10% off your first order when you sign up for our emails. We also run a rewards program that gives points for purchases and other activity. To take part, you give us your email address and, for rewards, your purchase activity. We estimate the value of this information to us is roughly equal to the discount or rewards you receive, based on our cost of offering them. Taking part is optional, and you can leave at any time by unsubscribing or closing your rewards account.

How long we keep information

We keep personal information only as long as needed for the reasons above. Order and payment records are kept as long as required for tax and accounting purposes, generally up to seven years. Marketing data is kept until you unsubscribe or ask us to delete it. Analytics data is kept for up to 14 months.

Security

We use reasonable administrative, technical and physical safeguards, and our store and checkout run on Shopify's secure, PCI-compliant platform. No system is completely secure, so please contact us right away if you notice anything suspicious on our site or checkout.

Children

Our site is for a general audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13, or sell or share the personal information of anyone under 16. If you believe a child has given us information, contact us and we will delete it.

Visitors outside the United States

We are based in the United States and your information is processed here. US privacy laws may differ from those where you live.

Changes to this policy

We will post any changes here and update the effective date. If we make material changes, we will let you know by email or a notice on our site.
